These general terms of use (the "Terms") are issued by FEF COMPANY, a French company registered with Registre du Commerce et des Sociétés (RCS), under company number 917540171, with its registered office at France & Company, 1/3 rue d'Enghien 75010 Paris France, ("MySmartCV" or "we"). They define the terms of use of the https://mysmartcv.co website (the "Website") and the services of MySmartCV (the "Services")
The T&Cs apply to any person browsing the Website and/or using the Services (the "User" or "you"). By browsing the Website and/or using the Services, you acknowledge that you have read and fully accepted these T&Cs without reservation and agree to comply with them.
Please read the following carefully. If you do not accept these T&Cs and/or have reservations about them, do not use this Website.
We may modify these Terms and Conditions at any time and without prior notice. The modifications will take effect immediately after their publication on the Website. It is your responsibility to regularly review the Terms and Conditions to be aware of these modifications. The continued use of the Website and/or Services by the User after any modification of the Terms and Conditions constitutes acknowledgment and acceptance of these modifications. If you do not accept the new conditions, you must stop using the Website and Services.
To improve the customer experience, we may also modify, without prior notice, the structure and design of our Website, as well as certain Services or content.
The Website allows you to view information related to our Services and our company. It also allows you to contact us.
Our Services include providing a platform that allows Users to create resumes and cover letters using templates available on the platform ("Templates"), modify their resumes and cover letters by uploading them to the platform, improve the content of their resumes and cover letters using artificial intelligence, and download the modified resumes and cover letters, subject to a subscription.

Access to the Website is free. It requires the User to have a high-speed Internet connection and equipment that allows them to access and navigate the Website (computer, phone, etc.). The Internet connection, equipment, and any associated costs are the sole responsibility of the User.
Access to the Services is free and strictly reserved for Users, natural persons acting as consumers, who have created a user account.
To create your user account, you must enter your email address during the first step of creating your first CV. If no user account is already associated with this email address, a user account will be automatically created.
The User is informed that if their email address is already associated with a user account on another CV and cover letter creation platform operated by a company belonging to the same group as MySmartCV, they will not be able to create a user account to access the Services of MySmartCV. In this situation, the User will be invited to use the existing user account on the said other platform. This measure aims to ensure a consistent and secure management of user accounts across platforms operated by companies within the group.
By default, authentication to the Services is done by sending a secure link to the email address provided in the registration form. You can change the authentication method at any time and set up a password by accessing your personal space. In this case, authentication will be done by entering an email address and a secure password. You are required to keep your login credentials confidential and not share them with anyone. You are fully responsible for the use and security of your credentials. Any access to the Services using your credentials may result in your liability. MySmartCV reserves the right to suspend or revoke your account in case of abuse or violation of these Terms of Use.
You agree to inform us without delay in case of loss, theft, or unauthorized use of your credentials so that we can take appropriate measures without delay to remedy the situation. In case of forgetting or losing your credentials, you can authenticate via the sending of a secure link to your email address.
You can terminate your access to the Services at any time.
You guarantee that your account contains accurate and correct information and that you will update it if necessary. If we believe that this information is incorrect or incomplete, we have the right to deny your access to the Website or any of the Services and to terminate or suspend your user account.
To be able to download CVs created using our Services, as well as create and download cover letters via our Services, the User must subscribe to a paid Subscription (see definition below). The different subscription plans are described on the Website.
3.4. Technical Requirements and Interoperability
The Services are compatible with the latest versions of major web browsers (Google Chrome, Mozilla Firefox, Safari, Microsoft Edge). Some features require access to a stable Internet connection and compatible hardware (computer or mobile device). MySmartCV does not guarantee the interoperability of the Services with third-party systems not mentioned in these Terms of Use.
The User agrees to use the Website and/or the Services in good faith, in compliance with all applicable laws and regulations. As such, the User specifically agrees not to:
Harm the rights and image of MySmartCV and its affiliated companies, including their intellectual property rights;
Infringe upon the rights and image of any party holding rights over the Templates, such as their intellectual property rights.
Open a user account on behalf of someone other than themselves;
Disrupt or interfere with access, the peaceful use by any other user, or the proper functioning of the Website and Services, including by introducing viruses, malicious code, or any other technology harmful to the Website and/or Services;
Test the vulnerability of the Website and/or Services, breach the security, identification, and authentication measures of the Website and/or Services, or more generally, access or attempt to access the Website or Services in an unauthorized manner;
Use the Website and/or Services for purposes other than those for which they were intended;
Engage in any form of unlawful data extraction from the Website and/or Services, including via web scraping; and
Use the Website and/or Services in any way for the design, creation, distribution, or commercialization of similar, equivalent, or substitute products or services, or similar, equivalent, or substitute documentation.
In case of violation of these rules, the User risks suspension or termination of their account, without prejudice to any other legal action.
To access certain Services, you must subscribe to a subscription (the "Subscription"). After subscribing, the User must finalize this subscription by making the payment. The Subscription will only be confirmed upon receipt of the corresponding payment.
MySmartCV will systematically confirm the subscription by email.
In order to process the subscription, the User must provide certain information related to their contact details and payment method. This information must be complete and accurate. Otherwise, MySmartCV will not be able to process the subscription.
MySmartCV reserves the right to cancel or refuse the subscription of a User with whom there is a dispute regarding a previous Subscription.
The prices of the Subscriptions are indicated on the Website. They are displayed in euros and include all taxes.

MySmartCV reserves the right to modify the price of the Subscription and any trial offer at any time. For ongoing Subscriptions, the User will be informed of this change at least 10 days before the end of the Subscription period, and the new price will take effect for the renewed period. Changes in trial offer prices will not affect ongoing trial offers.
The Subscription is payable by credit card via the payment system provided by our payment service provider.
It is the User's responsibility to save and print their payment certificate if they wish to keep their banking details and transaction information. The corresponding invoice will be sent to the User by email.
The User guarantees that they are fully authorized to use the payment method for their Subscription and that this payment method provides access to sufficient funds to cover all costs resulting from the Subscription.
The User may terminate his/her Subscription at any time for the future by completing the termination form available online or by sending an email to the following address: support@mysmartcv.co.
The cancellation will take effect at the end of the current Subscription period, provided that the cancellation request is made before the automatic renewal date. If the cancellation is made after this deadline, the Subscription will be renewed for an additional period, and the cancellation will take effect at the end of this new period.
Cancellation does not entitle the User to any refund for the current Subscription period. However, the User will continue to have access to the Services until the end of that period.
In the event of non-payment or a serious breach of these Terms and Conditions, MySmartCV reserves the right to terminate the Services after notifying the User by email, without refunding any amounts paid for the current period and without prejudice to MySmartCV's right to claim compensation for any damages suffered as a result of this breach.
The cancellation of the Subscription terminates the User's access to the paid Services at the end of the current Subscription period.
In accordance with Article L.215-4 of the Consumer Code, we reproduce below the provisions of the Consumer Code applicable to subscriptions:
Article L. 215-1
For service contracts concluded for a fixed term with a tacit renewal clause, the professional service provider must inform the consumer in writing, by a personalized letter or a dedicated email, no earlier than three months and no later than one month before the end of the period allowing the rejection of the renewal, about the possibility of not renewing the contract with the tacit renewal clause. This information, provided in clear and understandable terms, must specify, in a visible box, the deadline for non-renewal.
If this information has not been provided to them in accordance with the provisions of the first paragraph, the consumer may terminate the contract free of charge at any time from the renewal date.
Advances made after the last renewal date or, in the case of contracts of indefinite duration, after the date of transformation of the initial fixed-term contract, are refunded within thirty days from the termination date, after deducting the amounts corresponding to the execution of the contract up to that date.
The provisions of this article apply without prejudice to those that legally subject certain contracts to specific rules regarding consumer information.
By way of exception to the first paragraph of this article, for contracts for the provision of television services within the meaning of Article 2 of Law No. 86-1067 of September 30, 1986, relating to freedom of communication, and for contracts for the provision of on-demand audiovisual media services, the consumer may terminate the contract free of charge at any time from the first renewal, provided they change their residence or their tax household changes.
Article L. 215-1-1
When a contract has been concluded electronically or by other means, and when, at the time of termination by the consumer, the professional offers the consumer the option to conclude contracts electronically, the termination is made possible through this method.
To this end, the professional provides the consumer with a free feature that allows them to electronically complete the notification and the necessary steps for contract termination. When the consumer notifies the termination of the contract, the professional confirms receipt of the notification and informs them, on a durable medium and within a reasonable timeframe, of the date the contract ends and the effects of the termination.
A decree shall specify the technical modalities necessary to ensure the identification of the consumer and easy, direct, and permanent access to the functionality mentioned in the second paragraph, including its presentation and use. It shall also determine the information to be provided by the consumer.
Article L. 215-2
The provisions of this chapter, with the exception of Article L. 215-1-1, do not apply to operators of drinking water and sanitation services.
Article L. 215-3
The provisions of this chapter also apply to contracts concluded between professionals and non-professionals.
Article L. 241-3
When the professional has not made the refund under the conditions provided for in Article L. 215-1, the amounts due shall bear interest at the legal rate.
MySmartCV is committed to providing, for a reasonable duration, the necessary updates to maintain the compliance of the Services, particularly in the event of technical evolution or vulnerability correction. These updates will be automatically applied or will require action on your part, which will be notified to you in due time.
You are responsible for installing the available updates, unless we have explicitly agreed that they will be provided without your intervention. We disclaim all liability in the event of non-compliance resulting from a failure to install updates when you have been properly informed of their availability.
The Services incorporating features based on Artificial Intelligence Systems are provided to assist the User in creating resumes and cover letters. However, MySmartCV does not guarantee the accuracy of the Results generated by these AI Systems. The User acknowledges that it is their responsibility to validate these Results before any use or implementation. The Results generated by AI systems do not constitute personalized professional advice and are used entirely at the User's own risk.
The term "Artificial Intelligence System" refers to any software system deployed by MySmartCV as part of the Services, based on algorithms or machine learning models, designed to perform specific tasks autonomously or semi-autonomously, such as content generation. The term "Results" refers to the outputs generated by the Artificial Intelligence System based on the information entered by the User, including but not limited to content produced through the Services.
The Results generated by Artificial Intelligence Systems integrated into the Services, based on the information entered by the User, are and remain the exclusive property of MySmartCV.
MySmartCV guarantees that the Artificial Intelligence Systems are developed according to reasonable standards and include measures aimed at minimizing algorithmic biases, without guaranteeing their complete absence.
The Website, Templates, Services, and their content are protected by intellectual property rights, including copyrights and trademarks, which are the exclusive property of MySmartCV and/or its licensors. Any full or partial representation or reproduction of the Website and/or Services without the express authorization of MySmartCV would constitute an infringement under the applicable intellectual property regulations. The same applies to databases available on the Website and/or Services, which are also protected.
These Terms of Use should not be interpreted as transferring ownership of the Website and/or Services to the User. MySmartCV retains all rights related to artificial intelligence models, including their algorithms and any improvements or modifications made as a result of the User's use of the Services.
You retain your rights over any information or content that you submit, post, or display on or via the Website, including information related to your user account, résumés imported into the platform, your professional and educational background, and any other details you provide (“Your Content”). By submitting, uploading, posting, or displaying Your Content through our Services, you grant MySmartCV a non-exclusive, free, and transferable worldwide license to use Your Content solely for the purpose of providing the Services.
You guarantee that Your Content will not infringe upon the rights of third parties and that you hold all necessary rights to submit this content to us within the scope of the Services.
If you believe your intellectual property rights have been infringed, please contact us.
You are responsible for the use of Your Content and any potential consequences, including those arising from third parties' use of Your Content when shared. We are not responsible for the use of Your Content, nor for the use of any content or information submitted or published by other Users.
MySmartCV’s publishing services facilitate the publication of Your Content and Customized Documents on various third-party career sites with your prior request and consent. You agree that MySmartCV may use proprietary web data collection tools to create a personalized profile for you if you subscribe to this Service. You further agree that the text and interpretation of your information for the purpose of résumé publication services will be at MySmartCV’s sole discretion, and MySmartCV will not be responsible for any decision to include, exclude, or edit information about you. Additionally, you acknowledge and agree that you will assume full responsibility and be personally accountable for any consequences arising from your use of the résumé publication Services.
No service level is offered.
MySmartCV implements the necessary technical and organizational measures to ensure the security and integrity of its online services in accordance with applicable standards.
In the event of a security incident, threat, or vulnerability affecting the services or the User’s data, MySmartCV may take the following measures:
Inform the affected Users of the incident or identified risks if they are likely to impact their data or use of the services.
Apply security fixes or updates immediately to address any identified vulnerabilities.
Temporarily suspend access to all or part of the services to protect Users and ensure data integrity if necessary.
Implement enhanced security controls (such as two-factor authentication) to secure User accounts.
Conduct a security audit to assess the impact of the incident and restore a secure environment.
In the event of a serious incident, report the incident to the competent authorities and, if necessary, cooperate with them to limit the consequences.
MySmartCV guarantees that the digital services provided to users under the Services comply with these terms, in accordance with the provisions of Directive (EU) 2019/770 and applicable national legislation.
The consumer has a period of two years from the provision of the digital content or digital service to enforce the legal conformity guarantee in the event of a lack of conformity. During a period of one year from the date of provision, the consumer is only required to establish the existence of the lack of conformity and not the date of its occurrence.
The legal conformity guarantee includes the obligation to provide all necessary updates to maintain the conformity of the digital content or digital service.
The legal conformity guarantee gives the consumer the right to bring the digital content or digital service into conformity without undue delay following their request, free of charge and without major inconvenience to them.
The consumer may obtain a price reduction while retaining the digital content or digital service, or they may terminate the contract by obtaining a full refund in exchange for relinquishing the digital content or digital service if:
1° The professional refuses to bring the digital content or digital service into conformity;
2° The conformity of the digital content or digital service is unduly delayed;
3° The conformity of the digital content or digital service cannot occur without costs imposed on the consumer;
4° The conformity of the digital content or digital service causes a major inconvenience to the consumer;
5° The non-conformity of the digital content or digital service persists despite the professional’s unsuccessful attempt to rectify it.
The consumer is also entitled to a price reduction or contract termination when the lack of conformity is so serious that it justifies an immediate price reduction or contract termination. The consumer is then not required to request the conformity of the digital content or digital service beforehand.
In cases where the lack of conformity is minor, the consumer is only entitled to contract cancellation if the contract does not require payment of a price.
Any period of unavailability of the digital content or digital service for the purpose of bringing it into conformity suspends the warranty that remained in effect until the provision of the newly compliant digital content or digital service.
The rights mentioned above result from the application of articles L. 224-25-1 to L. 224-25-31 of the Consumer Code.
Any professional who, in bad faith, obstructs the implementation of the legal guarantee of conformity is liable to a civil fine of up to 300,000 euros, which may be increased to 10% of average annual turnover (Article L. 242-18-1 of the Consumer Code).
The consumer also benefits from the legal guarantee of hidden defects in application of articles 1641 to 1649 of the civil code, for a period of two years from the discovery of the defect. This guarantee gives the right to a price reduction if the digital content or digital service is kept or to a full refund against waiver of the digital content or digital service.
The Website and Services are provided "as is," without any warranty. MySmartCV does not guarantee that the Website and Services are free of errors or omissions or that the Website and Services will always be available and accessible without interruption. Access to the Website and/or Services is permitted on a temporary basis. MySmartCV reserves the right to suspend, withdraw, interrupt, or modify all or part of the Website and/or Services without prior notice.
MySmartCV shall not be held liable if, due to force majeure as defined by French jurisprudence, or for reasons beyond its control, MySmartCV is unable to fulfill its obligations.
The User acknowledges using the Website and/or the Services at their own risk. It is expressly reminded that the Internet is not a secure network. MySmartCV cannot, therefore, be held responsible for contamination by potential viruses or the intrusion of a third party into the User's terminal system and disclaims all liability for any consequences resulting from their access to the Website and/or Services that are not attributable to MySmartCV. More specifically, MySmartCV cannot be held responsible for any damage not attributable to it, caused to the User's computer equipment and the data stored therein, as well as any consequences this may have on their personal or professional activity. It is therefore the User’s responsibility to take all appropriate measures to protect their equipment and the data stored on it against any harm.
MySmartCV disclaims all liability in case of Internet network malfunctions, telephone line failures, or reception equipment issues preventing access to the Website and/or Services.
MySmartCV declines all responsibility for inaccuracies or omissions in data processed by Artificial Intelligence Systems when such data originates from information provided by the User. The User is solely responsible for the use, publication, or communication of the Results. The User acknowledges that the use of Artificial Intelligence Systems requires human supervision to validate the generated Results.
We collect and process some of your personal data as a data controller. For more information on how your personal data is processed, you are invited to consult our Privacy Policy.
Our Website contains links to other websites. We do not control these websites and are not responsible for their content. MySmartCV is not responsible for the privacy practices or the content of these sites.
You have the right to withdraw from the contract without giving any reason within 14 days. The withdrawal period expires 14 days after the date of the contract conclusion.
To exercise the right of withdrawal, you must notify FEF COMPANY (France & Company, 1/3 rue d'Enghien 75010 Paris France, – support@mysmartcv.co - +33 189623434) of your decision to withdraw from this contract by means of an unambiguous statement (for example, a letter sent by post or an email). You may use the withdrawal form template attached, but it is not mandatory. To meet the withdrawal deadline, it is sufficient for you to send your communication regarding the exercise of the right of withdrawal before the withdrawal period expires.
In the event of your withdrawal from the contract, we will reimburse all payments received from you without undue delay and, in any case, no later than 14 days from the day we are informed of your decision to withdraw from this contract. We will make the reimbursement using the same means of payment as you used for the initial transaction unless you expressly agree otherwise; in any case, this reimbursement will not incur any fees for you.
If you requested to begin the provision of services during the withdrawal period, you must pay us an amount proportional to what has been provided to you up to the moment you informed us of your withdrawal from the contract, relative to the total services provided in the contract.
You will not be able to exercise your right of withdrawal in the case of the provision of digital content or services fully performed before the end of the withdrawal period, where execution began after your prior express agreement and explicit waiver of your right of withdrawal.

MySmartCV retains any contract concluded with a User for 10 years, involving an amount equal to or greater than 120 euros, and guarantees the User access to it at any time upon request.

These T&Cs in French will be executed and interpreted in accordance with French law. If your habitual residence is located in another country of the European Union, you also benefit from rights protecting you under the mandatory provisions of the law applicable in your country of residence.
In the event of a dispute, the User is invited to first contact MySmartCV to seek an amicable solution by reaching out to the following address: support@mysmartcv.co.
The User also has the option, if they wish, to use a consumer mediator free of charge to amicably resolve the dispute with MySmartCV, after having sent a written complaint to the latter. In any case, the User retains the right to refer the matter to the competent courts of their choice to assert their rights.
